Terms of Use

These Terms of Use apply to bookings made through agafaydesert.com. By submitting a booking, you agree to these terms. If you have any questions before booking, please contact us using the details in Section 24.

Please also read our Privacy Policy, which explains how we handle the information you provide when booking.

A booking must be made by an adult on behalf of themselves and their group, which may include children. The person making the booking is responsible for the accuracy of the information submitted for every participant included in it.

You are responsible for providing accurate information when booking — including participant ages, contact details, and pickup location. Participant ages directly determine the correct price and which activities a participant may take part in (see Section 8), so please enter them correctly. If information you provided turns out to be incorrect, please contact us as soon as possible so we can help resolve it.

All prices are shown in Moroccan Dirham (MAD) on the relevant experience and booking pages. Pricing is per participant: each participant is priced according to their age — infants (0–2) are free, children (3–15) are charged the experience's child price, and adults (16+) are charged the adult price. Where an experience includes an optional single-vehicle upgrade, it is priced per participant who selects it, not per booking.

The final price shown on the booking form and confirmation page, calculated by our server at the time you submit your booking, is the price that applies to your booking.

Payment is currently collected on site, in cash, at the time of your activity. This website does not currently process online payments, and no card, bank, or online payment details are collected or stored by this website.

Bookings made through this website are confirmed instantly. After submitting your booking, you will be shown a confirmation page with a unique booking reference — please save this reference, as it is your record of the booking. This website does not currently send an automated confirmation by email, WhatsApp, or SMS.

Each experience operates daily, with a small number of fixed start times shown on its booking page (all times are local Marrakech time). Same-day booking is available, up to 1 hour before the selected start time. The exact start times and total duration for each experience are shown on that experience's page at the time of booking.

The following age rules apply to every experience on this website:

• Infants (0–2): free of charge, and counted as part of the booking. An infant does not independently participate in or drive any activity.
• Children (3–15): charged the experience's child price. A child may ride as a passenger on a quad bike or buggy, where the experience includes one, but cannot drive.
• Adults (16+): charged the experience's adult price, and may drive a quad bike or buggy where the experience includes one.

A participant who rides as a passenger is a paid participant at the experience's child or adult price — there is no free child passenger.

Only participants aged 16 or over may drive a quad bike or buggy. No driving licence is required for any participant, at any age. Standard vehicles carry 2 people; a driver-eligible participant (16+) may instead choose a single-vehicle upgrade for themselves, priced per person as shown at booking — this option is not available to participants under 16, who remain passengers on standard vehicle allocation.

All drivers and passengers must follow the guide's and staff's safety instructions at all times — see Section 18.

Pickup is included within 5 km of Marrakech city centre. Pickup outside that area may require an additional fee. If our vehicle cannot reach your riad or hotel because of narrow streets or access restrictions, you will be asked to meet the driver at a nearby accessible pickup point.

You can provide your pickup location by typing a place name or address, by optionally sharing your current location through your browser, or both — see our Privacy Policy for how that information is used.

• Provide accurate booking information, including participant ages.
• Be ready at the agreed pickup location at the agreed time.
• Ensure any children in your group are supervised by a responsible adult throughout the activity.
• Communicate any dietary requests, allergies, or special requests in advance.
• Follow the guide's and staff's instructions throughout the activity.

Please be ready at the agreed pickup location and time. If the scheduled transport has already left and no alternative guide or vehicle is available, you may make your own way to the activity location by taxi, at your own expense, where this is operationally possible, and you may return using our transport. Transport-related refund or deduction terms (see Section 13) may apply. We cannot guarantee that an activity can always be joined after a late arrival.

• 24 hours or more before your activity: free cancellation.
• Less than 24 hours before your activity: transport-related costs may be deducted from any refund due.

The exact transport-cost deduction is assessed on a case-by-case basis.

If you do not arrive for your activity without cancelling in advance, transport-related costs may be deducted from the refundable amount.

If weather conditions prevent an activity from running safely, your booking may be rescheduled to another suitable day at no extra charge. If the alternative day offered does not suit you, you may receive a full refund. No specific weather thresholds are defined in advance — this decision is made based on conditions at the time.

Because payment is currently collected on site rather than in advance (see Section 5), most cancellations do not involve returning a prior online payment. Where these terms refer to a refund — for example, under Section 13, Section 14, or Section 15 — that refers to any amount already paid to us, and the transport-related deduction terms above may still apply as our operating policy.

If you would like to change your booking's date, time, or details after submitting it, please contact us as soon as possible. Changes are handled on a case-by-case basis and depend on availability — we cannot guarantee that a requested change can always be made.

Quad biking, buggy driving, and camel riding are outdoor desert activities that carry inherent risks. All participants must follow the safety instructions given by our guides and staff at all times. Only participants aged 16 or over may drive a quad bike or buggy (see Section 9). Parents or guardians are responsible for supervising any children in their group throughout the activity.

We aim to keep this website's information accurate and the booking form available, but we cannot guarantee uninterrupted availability or that every detail shown is always error-free. If a clear pricing or availability error occurs, we may contact you before confirming a booking affected by it.

The text, images, and design of this website belong to Agafay Desert or are used with permission, and may not be copied or reused without our consent.

To the extent permitted by applicable law, Agafay Desert is not responsible for indirect losses or for delays and disruptions caused by circumstances beyond our reasonable control, such as weather or road conditions. Nothing in these terms is intended to exclude any liability that cannot legally be excluded.

This website and the business behind it are based in and operate from Morocco. These terms are intended to be read and applied in that context.

We may update these Terms of Use from time to time, for example as the website or booking process changes. The version published on this page applies, and the date at the top of this page shows when it was last updated.
